Can PIL Alleviate the Fear of Leprosy and Change Its Impact on Divorce Grounds?

    History of Leprosy

In India, the disease known as leprosy has been shrouded in myths and misconceptions for so many centuries. Throughout history, there have been stories that have spread the idea that leprosy is a genetic disease that is contagious and is linked to dirty blood and poverty. Moreover, there were those who believed that it could be transmitted through food and water, which made the diagnosis more challenging. However, these beliefs are not supported by any scientific evidence.

    The science behind Leprosy disease

One of the most common misconceptions about leprosy is that it is caused by the bacterium known as Mycobacterium Leprae. The condition is not inherited, nor is it a result of living in living conditions that are deficient in resources. Although it is a chronic infectious condition, early detection and consistent treatment are essential for successful recovery. This is especially true when the treatment is administered according to the Multi-Drug Therapy (MDT) regimen. Leprosy is not an insurmountable disease, despite the fact that the risk of infection can be increased by situations such as living in an unsuitable environment, being malnourished, and not practicing proper personal hygiene.

    Multi-Drug Therapy

In the early 1980s, a significant breakthrough in the treatment of leprosy occurred when the introduction of Multi-Drug Therapy (MDT) was established. Rifampicin, Clofazimine, and Dapsone are examples of medications that, when used in conjunction with one another, are able to effectively combat the bacillus that causes Hansen Syndrome. Through the use of MDT, more than fifteen million people who were afflicted with leprosy have been successfully cured over the course of the past twenty years.

PIL: Bridging the Gaps in Knowledge

Through the filing of a public interest litigation (PIL), an effort was made to alleviate the anxiety that is associated with leprosy by requesting that the central government carry out periodic national surveys. In the case of Pankaj Sinha vs. Union of India, the Supreme Court of India issued guidelines with the intention of increasing both awareness and accessibility to treatment.

    Guidelines for Awareness:

National Surveys: In order to determine the prevalence and detection rates, regular national surveys are conducted.

Massive Awareness Campaigns: Annually held on World Hansen’s Disease Day, with the purpose of educating the general public about the signs, symptoms, and treatment options available for leprosy.

Pharmaceutical Accessibility: The availability of MDT treatments should be made free of charge in all health care facilities.

Non-Discrimination: Bring attention to the fact that people living with leprosy are able to lead normal lives, take part in social activities, and either work or go to school.

Inclusive Education: Consider incorporating education about leprosy into the curriculum of schools in order to eliminate discrimination.

    Legal Consequences for Divorce

The effects of leprosy extended beyond the body and into the legal system. Section 13 (iv) of the Hindu Marriage Act of 1955 acknowledged the incurable, deadly form of leprosy as a reason for dissolution of a marriage. But anti-discrimination legislation was gradually amended. In a move that was in line with global resolutions against prejudice, the Supreme Court of India removed leprosy as a basis for divorce in the case of Pankaj Sinha vs. Union of India.
